Negligence judgment reversed and plaintiffs granted a new trial when juror erroneously told other jurors that it did not matter how they answered the special issues because plaintiffs would recover anyway. Reese v. Britain, 570 S.W.2d 528 (Tex. Ct. App. 1978). Will contest judgment was reversed when one juror gave other jurors erroneous instructions on the law of undue influence. In determining whether this was an overt act, the court listed the following factors as significant: nature of the conduct, significance of the conduct, presence or absence of a rebuff, whether the statements were asserted as matter of opinion or fact, the timing of the misconduct, duration of deliberations and any other matters occurring during trial that might have a bearing. Id. at 533. Dealing with misconduct When an employee has done something or failed to do something which adversely affects his/her work, the ability of others to do their work, or the agencys mission, a supervisor is faced with decisions on how to handle the incident or series of incidents. First, the supervisor must decide whether the incident involves the employees poor job performance or an act of misconduct or delinquency. Normally, it is one or the other, but in some cases it could be both. Next, the supervisor must decide what type of management action will best deal with the incident(s). If it is misconduct or delinquency, such as tardiness, failure to properly request leave, insubordination, theft, etc., then an option could be to take disciplinary action. A non-disciplinary adverse action is an adverse action taken for reason(s) other than to correct an employees delinquency or misconduct. However, as a reader pointed out when I used the words mediator and arbitrated in a sentence illustrating the difference between uninterested and disinterested, the roles of mediator and arbitrator in a legal context are distinct. Mediation may or may not result in a satisfactory settlement. With arbitration, the disputing parties (usually) agree in advance to accept the decision of the arbitrator/s. Sand-Jecklin studied demographic data of 150 nursing students. Their motivations for entering the nursing field were reported. Twelve percent chose nursing for the variety of positions the profession entails; other reasons were job security, salary, and challenging career. Across the literature, findings show that among the positive perceptions of nursing, mainly found from studies on nursing students, are job opportunity and salary. Barney Vs. Sesame Street Sesame Street and Barney The Dinosaur are two popular educational shows for children. Are they really teaching kids with the right techniques? Are they teaching kids anything at all? It's a battle to see which is better: Barney or Sesame Street. Sesame Street and Barney have totally different teaching techniques. Sesame Street captivates the audience with high joltage and fast scenes. The child barely understands what is going on and when they understand that scene, it's over and the next scene is almost done. The child does not learn well under these circumstances. Barney does not have the same JPM as Sesame Street but it still attracts the audiences' attention. The show is slower and more understandable than Sesame Street. Barney focuses on one topic for every show. The one that I watched, entitled "Up We Go", was about flying. You learn about kites, birds, planes and more. You get more out of the show than if it was about many topics like Sesame Street. The one we saw had many topics like eating healthy, dental hygiene, the airport and more. The child can have an overload of ideas for one day and get all mixed up. Both Barney and Sesame Street have songs in them. I found that Barney had many more songs than Sesame Street. The songs are used as jolts and they work well in getting the attention of the child. I found that the Barney songs were much catchier than the Sesame Street songs. They were slower, and other than the dancing, there was not much else happening. On Sesame Street, the background was changing, things were flying and colors were jumping. The attention was not put on the song by the kids, it was put on the actions on the screen. Barney, like Sesame Park, showed minimal biases regarding sex and race. The cast consisted of three boys and three girls. One boy was disabled but was as able as the other kids. The races on the show were mixed. They consisted of a Latino boy, a Chinese girl, an African-American girl and more. On Sesame Street there was less of a mix of races. How Emotions Rule: Leadership Concepts in Inside Out 1. Movie Summary Leadership can take form in a vast number of ways, from businesses to government to public speakers. Leadership can be found in nearly every species around the planet in some form. But what if you looked deeper into yourself to explore what governs you as a person? The movie Inside Out does just that, by characterizing the things that drive us from the moment we are born until the moment we die: emotions. This story follows an 11-year old girl named Riley and the 5 basic emotions that live inside her head and govern what she does: Joy, Sadness, Anger, Fear, and Disgust. A conflict occurs when her family packs up and moves to Los Angeles for a new job, and seeminglyâ⬠¦show more contentâ⬠¦2. Critique the Leadership Among all of the emotions, the one which exhibits the most leadership qualities is Joy. Going by the Big Five Personality Traits, Joy excels at the expectations of nearly of the traits. The first, being surgency, is completely natural to her character. Being the physical representation of joy itself, she is constantly energetic, extroverted and makes conversation whenever possible, even with Sadness, whom she does not like initially. When she is trying to raise Sadnessââ¬â¢s sprits to continue on and make their way back to headquarters, she makes Sadness think happy thoughts, which to Sadness include ââ¬Å"[a] good movie where [a] dog died.â⬠The second trait is conscientiousness, which Joy shows not through her teamwork with the other emotions, but through the dependability she has for Riley. Having been with her from the moment of her birth, Joy is committed to always see Riley happy, thus she never leaves her post at the control board until she and Sadness are taken away; and even then, Joy spends every moment looking for a way back to Riley. The third trait is agreeableness, which matches her personality perfectly. Everything Joy does or talks about is heavily optimistic.
